Fighting DUI/DWI Charges
Clients come to our law office with many questions about their drunk driving charges. Many are unaware of their legal options and the fact that it is possible — very possible — to fight DUI charges. While every drunk driving defense case is different, there are certain key factors that we look at when building a defense:
- Why was the driver stopped by the police? Did the police officer have a legitimate reason (probable cause) to stop the driver? If not, your case may be dismissed.
- Were field sobriety tests administered? Common field sobriety tests include standing on one leg and walking in a straight line. While these tests are often used, they are highly subjective. They do not test blood alcohol content (BAC) level, but rather driver behavior.
- Was a chemical test administered? The results of a chemical test (such as a Breathalyzer test or Intoxilyzer 5000 test) may or may not be valid. We will work to determine if the test was properly administered, if the individual who administered the test was qualified to do so, and if the results were valid.
